Terms of Service

These terms govern your use of the VariantFlow platform at thevariantflow.com ("the Service"). By using the Service, you agree to these terms.
1. Account and Access
- Access to VariantFlow is by invitation only. You may not share your credentials with others.
- You are responsible for all activity under your account.
- You must provide accurate information when setting up your account.
- We may suspend or terminate accounts that violate these terms or pose a security risk.
2. What You Can Do
- Create and manage A/B tests and personalization experiments on websites you own or have authorization to modify.
- Use the Visual Experience Composer to create visual changes to your web pages.
- View analytics and experiment results for your sites.
- Use AI-powered features to generate experiment suggestions and copy variations.
- Invite team members to collaborate on your sites with appropriate role-based access.
3. What You Cannot Do
- Install the VariantFlow script on websites you do not own or have authorization to modify.
- Use the platform to collect personally identifiable information without proper consent mechanisms.
- Attempt to circumvent rate limits, authentication, or security controls.
- Use custom JavaScript rules to inject malicious code, steal data, or redirect users to harmful sites.
- Reverse engineer, decompile, or attempt to extract the source code of the platform.
- Resell access to the platform or use it to provide a competing service.
4. Your Data
- You own your data. All experiment configurations, analytics data, and visitor events collected through your sites belong to you.
- We process your data solely to provide the Service. We do not sell, rent, or share your data with third parties for their own purposes.
- You can export your data at any time through the dashboard or API.
- If you delete your account, we will delete all associated data within 30 days.

5. Visitor Data and Consent
- You are responsible for ensuring that your use of VariantFlow on your websites complies with applicable privacy laws (including GDPR, CCPA, and others).
- VariantFlow provides a built-in consent banner. If you disable it, you must provide your own consent mechanism that meets legal requirements.
- You must not use VariantFlow to collect sensitive personal data (health information, financial data, etc.) without appropriate legal basis and safeguards.
6. AI Features
- AI-generated content (experiment suggestions, copy variations, visual designs) is provided as recommendations only. You are responsible for reviewing and approving all changes before they go live.
- Page content from your sites may be sent to third-party AI providers (Anthropic, OpenAI) when you explicitly use AI features. No visitor personal data is included in these requests.
- AI outputs may not always be accurate, appropriate, or aligned with your brand. Always review before applying.
7. Service Availability
- We strive to keep the Service available, but we do not guarantee 100% uptime.
- We may perform maintenance that temporarily affects availability. We will provide notice when possible.
- The client-side script (loader.js) is designed to fail gracefully — if our server is unavailable, your website continues to function normally with no visible impact to visitors.
8. Limitation of Liability
- VariantFlow is provided "as is" without warranty of any kind, express or implied.
- We are not liable for changes in your website's conversion rates, traffic, revenue, or other business metrics resulting from experiments run through the platform.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
- Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless VariantFlow from any claims, damages, or expenses arising from your use of the Service, your violation of these terms, or your violation of any third party's rights.
10. Termination
- You may stop using the Service at any time by removing the script from your website and requesting account deletion.
- We may terminate or suspend your access if you violate these terms, with notice when practical.
- Upon termination, your right to use the Service ceases. We will retain your data for 30 days to allow for export, then delete it.
11. Changes to These Terms
We may update these terms from time to time. Material changes will be communicated via email or in-dashboard notice. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.
12. Governing Law
These terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes will be resolved in the courts of Alameda County, California.
